Cannabis in the Workplace: A Positive Test Isn't the Whole Story
For years, many cannabis employers treated workplace cannabis issues as a simple question.
Did the employee test positive?
Today, that approach may create legal exposure, not just a policy question.
A positive test does not establish that an employee was impaired on the job. Standard urine screens detect inactive THC metabolites that can linger for days or weeks after use, long after any impairment has passed.
State law increasingly reflects this distinction. California, New York, New Jersey, Illinois, Connecticut now restrict adverse action based on a positive test alone, absent evidence of on-the-job impairment, and New York and Nevada limit pre-employment testing outright. More employers are shifting to oral fluid testing, which typically detects use within the past 24 to 48 hours, to better align with these laws. Safety sensitive and DOT regulated roles remain a clear exception, where federal rules still control.
For cannabis employers, the stakes are particularly high given cultivation, manufacturing, retail, delivery, and security sensitive positions across the operation.
Managers should focus on objective observations, documented behaviors, and consistent enforcement rather than trying to prove use.
As organizations expand into additional states, testing policy becomes a patchwork problem. A policy built for one jurisdiction may violate another.
The question for 2027 is no longer whether your company has a drug testing policy. It is whether that policy can withstand a challenge in every state where you operate.
Employers that align testing methodology with the law in each jurisdiction, train managers on documentation, and revisit policies as laws shift will be better positioned to manage risk.
Excelerator® helps cannabis employers develop workplace policies, manager training, and employee relations practices that support both compliance and operational performance.
