Labor Peace Agreements: The Cannabis Industry's Next Major Workforce and Licensing Challenge
Labor peace agreements have become one of the most important workforce and licensing issues facing cannabis operators, and a string of 2026 court decisions are reshaping how they work.
At least eight states require or encourage a labor peace agreement as a condition of a cannabis license. Unlike most industries, labor relations here can affect a company's license, not just its relationship with employees. Under a typical agreement, the licensed operator agrees to remain neutral during union organizing, and the union agrees not to strike or picket. The United Food and Commercial Workers and the Teamsters have been the most active unions organizing cannabis workers.
The legal landscape is shifting quickly. In August 2026, a federal court decided in Curaleaf Holdings v. New Jersey Cannabis Regulatory Commission that New Jersey's labor peace agreement requirement is preempted by the National Labor Relations Act, and the state has appealed. A similar Oregon requirement was struck down in 2025 and is now on appeal to the Ninth Circuit, while challenges in California and New York remain unresolved, adding to the uncertainty.
For now, these decisions apply narrowly to the parties involved, so most cannabis operators remain subject to their state's requirement unless a broader ruling or new legislation changes that.
Cannabis employers should:
- Review any labor peace agreement carefully before signing it, rather than accepting a union's draft as standard
- Train managers on what they can and cannot lawfully say or do during an organizing campaign
- Evaluate labor obligations as part of due diligence for any merger, acquisition, or expansion
- Track litigation in your licensing state, since requirements could change with little notice
As the cannabis industry matures, labor peace agreements are becoming a leadership priority. Employers who understand the current rules and prepare in advance will be better positioned than those caught off guard in 2027.
