What AI is already doing in your hiring process
Across most organizations today, AI-enabled tools are screening resumes, scoring candidates, and informing promotion decisions often with limited visibility into how those determinations are being made. That is a business risk before it is a legal one.
The tools themselves are rarely the problem. The problem is that most were adopted for efficiency, and the governance conversation either came later or didn’t happen. More jurisdictions are moving in this direction. The practical implication: every organization needs a clear inventory of what tools are influencing employment decisions and documented evidence that humans remain meaningfully in the loop.
Workforce monitoring: efficiency tool or trust risk?
Productivity tracking, remote activity monitoring, time-on-task analysis, and location data collection have expanded significantly since hybrid work became the norm. Most of these practices serve legitimate purposes. Very few are communicated clearly enough.
The monitoring conversation is fundamentally about trust and trust is a business asset. Organizations that monitor without telling employees aren’t necessarily breaking rules; they’re eroding the foundation that makes high performance possible. A useful gut check: if you would be uncomfortable explaining to your employees exactly what is being collected and why, that is a signal the practice deserves review before it needs a policy.
The governance gap hiding in plain sight
The most common AI governance failure today isn’t a bad tool. It’s the absence of any structured process for deciding how tools get adopted, who is accountable for their outcomes, and what happens when something goes wrong.
In most organizations, AI tools entered through the side door: a recruiting team tried a new platform, a manager adopted a scheduling optimizer, an L&D group deployed an AI coaching tool. None of it was coordinated. And now there are tools influencing employment decisions that no one in HR, legal, or the C-suite has formally reviewed.

Employee handbooks and internal policies carry more weight than most organizations realize. They signal to employees, federal, state, and local enforcement agencies, and legal counsel whether leadership has thought seriously about its responsibilities to the people it employs.
An AI policy is not a compliance checkbox. For employees, it is a signal that leadership has thought carefully about how technology affects them. For executives, it is a demonstration of governance maturity. For founders, it is part of the culture you are building.

Strong AI-related policies address how AI influences employment decisions, confirm that human judgment remains the deciding factor, explain what data is collected and how it is used, set expectations for employee use of generative AI tools, and give employees a clear path for questions or concerns. That last element, a mechanism for employees to raise issues, matters more than most organizations realize, both for trust and for early problem detection.
Five priorities for the leadership table
- Inventory all AI tools currently touching employment decisions including those adopted without central review and establish accountability for each
- Create a clear intake process so no new AI tool enters the people stack without HR, legal, and appropriate executive review
- Build manager and executive training that addresses what AI tools can and cannot tell you and where human judgment is non-negotiable
- Audit monitoring practices for consistency and legality across all locations, and communicate transparently with employees about what is collected and why
- Update employee handbooks and internal policies to reflect how AI is actually being used and then make sure managers and employees know what the policies say
These are governance decisions, not technology investments. They require executive sponsorship, HR leadership, and most importantly the organizational interest to treat people practices with the same rigor applied to financial or operational risk.
What this moment asks of leaders
The efficiency gains from AI are real. So are the risks when adoption moves faster than accountability. What separates organizations that benefit from AI from those that are hurt by it is not the sophistication of their tools it is the quality of their governance.
For founders, that means building AI accountability into company culture from the start. For C-suite leaders, it means treating AI governance as enterprise risk management. For HR professionals, it means getting ahead of the risk by building governance structures that make AI use in employment decisions defensible before they are ever challenged.
Organizations that get this right will be better places to work, better positioned with federal, state, and local enforcement agency investigations, internal complaints by employees, litigation, and better equipped to attract and retain talent.
